Court grants 2 days physical remand of fawad Chaudhary

Islamabad: Judge Tahir Mehmood Khan of the District and Sessions Court granted two more days physical remand of Fawad Chaudhry and handed him over to the police.

In the case of threats to the Election Commission, Judicial Magistrate Waqas Ahmed Raja passed a safe verdict at 6 pm, granted Fawad Chaudhary’s two-day physical remand and ordered the police to appear Fawad Chaudhry again in the court on Monday.

Written judgment

In a five-page written judgment issued by the District and Sessions Court, it has been written that the prosecutor sought physical remand of Fawad Chaudhry for 7 days and said that Fawad Chaudhry’s mobile laptop and other devices are to be recovered. According to Fawad Chaudhary, it is necessary to undergo a photogrammetric test.

It has been stated in the written decision that the lawyer of Election Commission also requested for further physical remand of Fawad Chaudhry. After hearing the arguments of the parties, a two-day physical remand is granted, after which they will appear before the court again on January 30. The written judgment said that the investigating officer is strictly enjoined to conduct the investigation on merit.

Taking into account the legal aspects raised by the Sessions Court, the 2-day physical remand of Fawad Chaudhry is approved.

Earlier, the important development in the case of threatening the Election Commission took place when the police challenged the decision to reject the physical remand of Fawad Chaudhry. The case of threatening the Election Commission was heard in the District and Sessions Court Islamabad in which Fawad Chaudhry was presented in the court.

The police filed an appeal against the decision before the Sessions Judge and requested that the decision of Judicial Magistrate Waqas Ahmed Raja be annulled and further physical remand of Fawad Chaudhry be given.

The prosecutor said that we have to do photogrammetry tests and recoveries, practically we got a one-day remand and the investigation could not be completed.

The court allowed the appeal of the police and ordered Fawad Chaudhry to be produced again before the magistrate for physical remand. On which Fawad Chaudhry was presented before the magistrate.

The District and Sessions Court annulled the decision of the Judicial Magistrate not to grant Fawad Chaudhry’s physical remand and to grant judicial remand. The session judge said that the decision of the magistrate not to remand him was not legally correct.
