Islamabad: Justice Tariq Mahmood Jahangiri of Islamabad High Court, after the press conference of Mian Javed Latif, inquired during the hearing on the petition against registration of terrorism cases against Secretary Information, PTV MD and Director News that “Is an allegation?” Can there be more than one case? If someone talks on TV and tweets in Islamabad, can a case be registered in Quetta?
During the hearing of the said case, Justice Tariq Mehmood Jahangiri again issued notices to the Attorney General of Pakistan and the Prosecutor General of Punjab and Khyber Pakhtunkhwa, Advocate Generals and Bar Consul representatives for assistance.
Justice Tariq Mehmood Jahangiri inquired that if the murder took place in Islamabad, then the FIR would also be filed here, then why no one appeared before the court on behalf of the lawyers’ organizations during the hearing yesterday on the other charges.
The court said that we have called lawyers’ organizations for support because there is misuse of registration of cases, how can hundred cases or thousands of cases be registered on one charge.
On this occasion, Additional Attorney General Manoor Iqbal Dogal said that if the position in the second FIR is different, then it should be looked at in this regard as well. Justice Tariq Mahmood Jahangiri remarked that wherever the incident happened or whoever spoke, the case will also be registered there.
The court inquired that where is the Attorney General? On which the Additional Attorney General said that they are abroad. Justice Tariq Mehmood Jahangiri said that the Attorney General should be asked to come to the next hearing and provide judicial assistance.
The lawyer said that the petitioners should go to the High Courts where the cases have taken place. On which the court said that the High Court is bound to implement the decision of the Supreme Court.
Justice Tariq Mehmood Jahangiri remarked that if the incident happened here, how can their cases be in the provinces, if the minister holds a press conference in PID, can a case of terrorism be made against the MD?
The petitioner’s lawyer said that the press conference of the minister has also been aired on other channels and the list has also been attached. Justice Tariq Mahmood Jahangiri expressed his anger and said, “Is there any law here?”
Later, the court extended the order to stay the proceedings against the petitioners with the above measures till the next hearing and postponed further hearing of the case till the second week of February.
