How human rights were violated by NAB amendments? CJ

Islamabad: Chief Justice of Pakistan Umar Atta Bandyal has said on PTI’s request against the amendment of NAB rules, how are basic human rights being directly violated by NAB amendments? Can every other person come to court when the budget is presented and that it was made wrong?

According to Leading News, a hearing was held in the Supreme Court on Imran Khan’s petition against the NAB amendments. Lawyer Khawaja Haris argued that the recent NAB amendments are in conflict with basic human rights and said that if all NAB cases were sent to the accountability courts, many people were acquitted of all charges.

Chief Justice of Pakistan Umar Atta Bandyal said that you seem to find a new point in the case after every weekend. Justice Mansoor Ali Shah said that how the NAB amendments are directly violating basic human rights? Can every other person come to court when the budget is presented and that it was made wrong? If FBR gives tax exemption to someone, will it violate basic human rights?

Chief Justice Umar Atta Bandial said that there is a benchmark of law below which there is lawlessness, we all agree that there should be a law of accountability. Can you transfer your rules?

Justice Mansoor Ali Shah said that the United Nations Convention on Persons with Disabilities is not a part of the Constitution of Pakistan, should the court order the Parliament to enact legislation on international conventions? In this way, the international convention came to be called the Constitution of Pakistan, the court can interfere in the laws made by the executive when it conflicts with the constitution.

Justice Ejaz-ul-Ahsan said that due to the corruption of public money, the rights of the people will be affected, the laws must be in accordance with international standards, there is no country in the world that supports corruption, I want amendments in the old NAB law. No concrete reason was found.

Justice Ijaz said that it is the job of the court to determine the standard of law, during the time of Hazrat Umar (R.A), there was accountability even for keeping an extra buffalo. Should make the crime so painful that no one dares to commit it, it may prove that the NAB amendments are made maliciously and to benefit certain individuals.

Justice Mansoor Ali Shah said that I do not agree that the court sets the legal standard, the legal standard is set by the constitution, not the court. If there are no laws on corruption, then the court can say to make them. Parliament has to make it, how can it be that the NAB amendments will be invalidated and the old law will automatically come into force?

Lawyer Imran Khan said that because of the current NAB amendments, the corrupt accused have been acquitted and are happily sitting at home, here people are sitting at home after sabotaging the constitution?
Justice Ejaz Lahasan said that with the NAB amendments, the corruption charges are now being waived off. Justice Mansoor said that when it was not proved after the trial whether a person is corrupt or not, how were the fundamental rights affected?

Justice Ijazul Hassan said that after the NAB amendments, the trial has been made so difficult that corruption cannot be proved.

Later, the court adjourned the hearing of the case to Tuesday, November 15, directing Imran Khan’s lawyer to complete the arguments by November 17.
