Marwat moves court seeking reinstatement of Gandapur as KP CM

Petition filed in FCC challenges resignation and appointment process, political tensions deepen within PTI ranks

ISLAMABAD: Member National Assembly (MNA) and expelled PTI leader Sher Afzal Khan Marwat has filed a petition in the Federal Constitutional Court seeking the restoration of Ali Amin Gandapur as chief minister of Khyber Pakhtunkhwa.

According to the petition, Marwat argued that Gandapur’s resignation was obtained under pressure and therefore holds no legal validity. He further claimed that the resignation process was carried out under instructions from a “convicted disqualified individual,” without directly naming anyone.

The petition also challenges the notification appointing Sohail Afridi as the new chief minister, terming it unconstitutional and requesting the court to declare the appointment null and void.

Marwat has urged the court to reinstate Gandapur as chief minister and cancel all official decisions taken following what he described as unconstitutional administrative actions.

The petition comes after Gandapur had stepped down from his position following internal party directions, amid a leadership change within the party structure. He had implemented instructions to resign from the chief ministership and maintained that he had complied with party decisions.

In response to the development, Gandapur distanced himself from the petition, stating that he has no involvement in any legal proceedings or related actions, and reaffirmed that he resigned in line with party instructions.

Meanwhile, PTI Chairman Barrister Gohar Ali Khan criticized the move, calling it part of an internal conspiracy against the party. He maintained that only the party leadership has the authority to decide the chief minister’s position.

Gohar also stated that Sohail Afridi was appointed with the approval of the party leadership, adding that the decision cannot be reversed unilaterally.

The case highlights growing internal divisions within the party as legal and political disputes continue to unfold over leadership changes in Khyber Pakhtunkhwa.
