Islamabad: The Supreme Court declared the Lahore High Court’s order to inform Hamza Shehbaz before his arrest against the law.
According to Leading News, a hearing was held on NAB’s request against the Lahore High Court’s order to inform PML-N leader Hamza Shehbaz before arrest, in which a 3-member bench headed by Justice Ejaz-ul-Ahsan informed NAB before arrest in the case. The Lahore High Court’s order to do so was declared null and void.
The Supreme Court declared that there is no requirement in the law to inform the accused before arrest. Lahore High Court’s order to inform before arrest is against the law. The order to inform Hamza Shehbaz 10 days before the arrest should not be used as a judicial precedent. The court disposed of the case on the grounds that the order of the Lahore High Court was ineffective.
It should be noted that the Lahore High Court had ordered Hamza Shehbaz to be informed before his arrest in the clean water, Ramzan sugar mills and excess assets case.
