No standard of Sadiq & Amin for unelected rulers, IHC

Islamabad: Chief Justice Islamabad High Court Athar Minullah issued a detailed judgment in a case related to disqualification petitions, in which he said that the high standard of Sadiq and Amin does not exist for unelected rulers.

A detailed decision was issued to reject the disqualification petitions of Asif Zardari and Fawad Chaudhary, in which Chief Justice Islamabad High Court Athar Minullah said that there is no claim of supremacy over elected representatives as judges. The high standard of Sadiq and Amin does not exist for any office holder except elected representatives. This scale is not even for the unelected people who ruled half the life of this country.

In a detailed judgment, the court held that the effects of disqualification under 62 One F are profound. Parliament can create its own mechanism of self-accountability of representatives. Fawad Chaudhary and Asif Zardari have not been convicted by any court of law. The disqualification of both public representatives was sought on disputed facts.

The Chief Justice of Islamabad High Court declared that an investigation is required to determine the disputed facts and during the investigation, the political opponents of the two representatives will benefit. no. The involvement of the courts in such investigations reduces the public’s trust in the elected representatives and the involvement of the courts in these matters also wastes the time of the common citizen.

It has been said in the verdict that Khawaja Asif was disqualified by the same court. After 7 months, the Supreme Court accepted his appeal. Meanwhile, the people of Khawaja Asif’s constituency were deprived of representation. Of course, during this time, Khawaja Asif also faced political loss and infamy.

Justice Athar Manullah declared that the people should be empowered to decide who will represent them. Only people can decide who is honest and trustworthy. Any error in rendering a judgment of incapacity results in irreparable harm.
